Apple wins case against Irish €13bn back tax order

The EC order that Apple pay €13 billion to Ireland has been over-ruled by the EU’s General Court.

The EC can now appeal the decision to the ECJ.

The case arose from the very low tax rate which Ireland imposed on Apple.

The EC argued that the low tax rate amounted to illegal state aid.

The General Court said that a beneficial tax rate did not constitute state aid.

Once again one of  Competition Commissioner Margrethe Vestager’s financial time penalties has been over-ruled.

Last year she lost a case against Starbucks.
